General Terms & Conditions for Seasonal Tickets

1. Company details

These Terms & Conditions govern the relationship between “Flamingo Water park” Ltd., company ID 207403205, VAT registration BG207403205 (optional registration under Art. 100, para. 1 of the Bulgarian VAT Act), registered in the Republic of Bulgaria, with registered office at Bulgaria, Varna 9000, Odessos district, 41–43 Marko Balabanov Street, ground floor, office 1.1 (hereinafter the “Company”), and customers purchasing seasonal and day tickets for the Company’s waterpark locations. By purchasing a ticket and accepting these Terms, the customer confirms that they have read, understood and agree to be bound by them.

Nothing in these Terms shall limit or exclude consumer rights granted under applicable law.

2. Scope and definitions

  • “Seasonal ticket” means a ticket granting entry to specified Company locations for the season period indicated on the ticket, subject to these Terms.
  • “Locations” means the waterparks operated by the Company under the Flamingo Waterparks brand, for which tickets and access are offered under these Terms.

3. Ticket purchase and payment

  • Tickets are purchased online through aquaparkbg.com or other official channels designated by the Company.
  • Prices are displayed primarily in euros (EUR), unless another currency is explicitly indicated at checkout. Stated amounts include applicable taxes unless otherwise specified.
  • Online payments on aquaparkbg.com are processed through myPOS and other payment service providers as shown at checkout. Payments may be processed by third-party payment service providers. The Company does not store full payment card details. Once payment is successful, the customer receives confirmation and an electronic ticket.
  • The customer is responsible for providing a valid email address and accurate details required for issuing the ticket.

4. Ticket Policy

4.1 Nature of tickets

All tickets sold by the Company are issued in digital form and constitute a limited, revocable license granting the holder access to the park in accordance with the specific ticket type purchased (e.g. season ticket, day pass). Tickets do not constitute property rights or ownership.

4.2 Season ticket validity

Season tickets are valid solely for the official operating season as determined and announced by the Company. The duration of the season, opening dates, and operating hours are subject to change subject to applicable law and reasonable assessment by the Company. Season tickets grant access for multiple entries during the season unless otherwise specified.

Ticket prices are published on the official website at aquaparkbg.com and may be changed. Any promotions or special offers, if available, will be published on the website. Monthly passes may not be offered in certain periods.

4.3 Non-refundable policy

All ticket purchases are final. To the fullest extent permitted by applicable law, tickets, including season tickets, are non-refundable, non-cancellable, and non-exchangeable once purchased, except where mandatory consumer protection laws provide otherwise.

4.4 Transferability

Season tickets are strictly personal and non-transferable. Any attempt to transfer, resell, assign, or otherwise dispose of a ticket without prior written authorization from the Company may result in immediate invalidation of the ticket without refund or compensation, except where required by applicable law.

4.5 Loss, theft, or unauthorized use

The Company shall not be held liable for lost, stolen, duplicated, or unauthorized use of tickets. The risk of loss passes to the customer upon issuance. Customers are responsible for safeguarding their tickets and credentials.

4.6 Park closure and service interruptions

For these Terms, force majeure includes events beyond the reasonable control of the Company, including but not limited to those listed below.

The Company does not guarantee uninterrupted access to all facilities or services. No refunds, compensation, or extensions shall be provided in the event of the following, except where required by applicable law:

  • Temporary or partial closure due to weather conditions
  • Technical failures, maintenance, or safety concerns
  • Force majeure events, including but not limited to natural disasters, pandemics, government actions, or other circumstances beyond reasonable control

4.7 Misuse and violations

The Company reserves the right, subject to applicable law and reasonable assessment, to refuse entry, revoke access, or cancel tickets without refund in cases of:

  • Breach of applicable laws or park regulations
  • Fraudulent, abusive, or suspicious activity
  • Unauthorized resale or commercial use of tickets

4.8 Pricing and errors

The Company reserves the right to correct any pricing errors, inaccuracies, or omissions, and to cancel or refuse orders placed under incorrect pricing or system errors, even if payment has been processed. In such cases, a full refund of the amount paid will be issued.

5. Cancellation and Refund Policy

5.1 General policy

All ticket purchases are final and binding. The Company does not provide cancellations, refunds, or exchanges once a transaction has been successfully completed, except as expressly required under applicable law.

5.2 Limited exceptions

Refunds may be granted solely under the following circumstances:

  • Duplicate or erroneous transactions
  • Verified technical failures resulting in non-delivery of tickets
  • Situations where a refund is mandated by applicable consumer protection legislation

All refund requests are subject to verification and approval subject to applicable law and reasonable assessment by the Company.

5.3 Refund request procedure

Eligible refund requests must be submitted by the customer:

  • In writing via email to info@aquaparkbg.com
  • With valid proof of purchase
  • Within 7 calendar days from the date of the transaction

Failure to comply with these requirements may result in rejection of the request.

5.4 Processing of refunds

Approved refunds will be processed within 7 to 14 business days and issued using the original payment method, unless otherwise agreed. Processing times may vary depending on the payment provider.

5.5 Fees and deductions

The Company reserves the right to deduct any applicable administrative, transaction, or processing fees from approved refunds, except where prohibited by applicable law.

5.6 Alternative remedies

In lieu of a monetary refund, the Company may, subject to applicable law and reasonable assessment, offer alternative remedies, including but not limited to:

  • Replacement tickets
  • Credit for future use
  • Extension of ticket validity

Such alternatives shall constitute full and final settlement of any claim.

5.7 No refund for non-use

No refunds, partial or otherwise, shall be provided for:

  • Unused or partially used tickets
  • Failure to attend or utilize the ticket during the valid season
  • Voluntary early departure or change of personal circumstances

This applies except where required by applicable law.

5.8 Cancellation by operator

In the event that the Company cancels the entire operating season prior to its commencement, customers may be entitled, subject to applicable law and reasonable assessment by the Company, to either:

  • A full refund of the purchase price
  • Credit valid for a subsequent season

No additional compensation, damages, or reimbursement shall be owed, except where required by applicable law.

6. Conduct and safety

  • Visitors must comply with the Park Rules, available on the website and on-site, which form an integral part of these Terms. Guests must follow staff instructions, safety rules and on-site signage at all times.
  • The Company reserves the right to deny entry or remove guests without refund in cases of aggressive, dangerous or inappropriate behaviour, except where required by applicable law.
  • Consumption of alcohol or other intoxicating substances must comply with local law and may not compromise the safety of others.

7. Liability

The Company takes reasonable care to provide a safe environment and quality service, but is not liable for damage arising from improper use of facilities, failure to follow instructions or events of force majeure.

To the extent permitted by law, the Company’s liability is limited to the value of the purchased ticket.

8. Right of withdrawal

In accordance with Art. 57(12) of the Bulgarian Consumer Protection Act, the right of withdrawal in distance contracts does not apply to leisure services where the contract provides for a specific date or period of performance. The purchase of tickets for entry to the Company’s waterparks falls within this category (leisure services with a defined season or visit date). Therefore, after a successfully completed purchase, the customer does not have a statutory right of withdrawal for distance contracts as described above, except where mandatory law provides otherwise.

9. Personal data

The Company processes personal data in accordance with applicable law and our Privacy Policy, published on the official website aquaparkbg.com (Flamingo Waterparks).

10. Applicable law and jurisdiction

These Terms are governed by Bulgarian law. Any disputes arising from or in connection with them shall be subject to the jurisdiction of the competent courts of the Republic of Bulgaria, except where mandatory EU law provides otherwise.

11. Online dispute resolution (ODR)

EU consumers may use the European Commission’s online dispute resolution platform:

12. Children, age and supervision

  • Access to the waterpark and certain attractions may be subject to age and height restrictions as posted on site and on aquaparkbg.com.
  • Children below the required age or height must be accompanied by a responsible adult in accordance with park rules.
  • Parents and legal guardians are responsible for children’s behaviour and safety.

13. Photography, video and marketing

Visitors accept that photo and video recording may take place at the parks for operational, informational or marketing purposes. If you do not wish to be recorded in a way that clearly identifies you, please inform staff on site.

14. Final provisions and contact

The Company may amend these Terms by updating this page on aquaparkbg.com. The updated Terms take effect from publication unless otherwise stated.
